§1 Conclusion of the Travel Contract
By registering, the customer offers SEA PIRATES – Diving Safari Red Sea a binding agreement to conclude a travel contract. Registration can be made in writing by fax or email. The registration is also made by the customer for all participants listed in the registration.
The customer is liable for their contractual obligations as for their own obligations, provided they have made a corresponding separate commitment through an explicit and separate declaration.
§2 Payment
Upon receipt of the invoice/confirmation, a deposit of 20% is required. The remaining payment is due no later than 5 weeks before the start of the trip, as described in the invoice, provided the trip can no longer be canceled for reasons specified in clauses 6.1 or 6.2.
Bookings made within four weeks before the start of the trip require the traveler to pay the entire travel price immediately. If the due travel price is not fully paid by the agreed-upon start of the trip, SEA PIRATES – Diving Safari Red Sea is released from the obligation to perform and may demand the corresponding cancellation costs unless there is a valid right to withhold payment.
§3 Services
Reception at the airport by our travel guide.
The customer will be met inside the airport building with a SEA PIRATES SAFARI sign and the necessary visa. The travel guide will reconfirm the customer’s return flight details.
SERVICES INCLUDED IN THE PRICE
- Full board
- 3 to 4 dives per day (depending on travel time and weather; night dives at the Brothers are prohibited)
- Tank, weights, air, dive guide, soft drinks

§4 Changes to Services and Prices
Changes or deviations in individual travel services from the agreed contents of the travel contract, which become necessary after the conclusion of the contract and are not caused by SEA PIRATES – Diving Safari Red Sea acting in bad faith, are permitted only if the changes or deviations are not substantial and do not affect the overall nature of the booked trip.
Any warranty claims remain unaffected if the changed services are defective.
SEA PIRATES – Diving Safari Red Sea is obligated to inform the customer about service changes or deviations immediately.
If applicable, the customer will be offered a free rebooking or cancellation. In the case of price increases of more than 5% of the travel price after the contract is concluded, or in the event of significant changes to a key travel service, the traveler can cancel the booking free of charge or demand participation in a trip of at least equivalent value if SEA PIRATES – Diving Safari Red Sea is able to offer such a trip at no additional cost to the traveler.
§5 Cancellation by the Customer, Rebookings, Replacement Persons
5.1 Cancellation
The customer may cancel the trip at any time before departure. The receipt of the cancellation notice by SEA PIRATES – Diving Safari Red Sea is decisive. Customers are advised to submit cancellations in writing. If the customer cancels the travel contract or does not undertake the trip, SEA PIRATES – Diving Safari Red Sea will demand compensation for the travel arrangements made and expenses incurred.
When calculating the compensation, any saved expenses and possible alternative uses of the travel services will be considered. SEA PIRATES – Diving Safari Red Sea may claim this compensation as a lump sum according to the following breakdown, depending on the proximity of the cancellation to the agreed travel start date, as a percentage of the travel price:
CANCELLATION PER PERSON
- General: 10% of the travel price
- From the 45th to the 30th day before departure: 20%
- From the 29th to the 22nd day before departure: 30%
- From the 21st to the 15th day before departure: 50%
- From the 14th to the 2nd day before departure: 75%
- Within 24 hours before departure: 100%
CANCELLATION FOR HALF/FULL CHARTER
- General: 10% of the travel price
- From the 60th to the 45th day before departure: 20%
- From the 44th to the 30th day before departure: 50%
- From the 29th to the 20th day before departure: 75%
- From the 19th day until departure: 100%
5.2 Rebookings
At the customer’s request, changes to the travel date, destination, departure point, accommodation, or mode of transport may be made after booking. SEA PIRATES – Diving Safari Red Sea may charge a rebooking fee per traveler.
5.3 Replacement Person
Until the start of the trip, the traveler can request that a third party take their place in the contract. The replacement person and the original traveler are jointly and severally liable for the travel price and any additional costs incurred by the replacement.
If a booked trip is not undertaken for reasons beyond SEA PIRATES – Diving Safari Red Sea‘s control, or if the traveler fails to arrive at the boat at the agreed time when traveling independently, this does not constitute a cancellation of the travel contract. In such cases, the traveler is still obliged to pay the full travel price.
§6 Cancellation and Termination by SEA PIRATES – Diving Safari Red Sea
SEA PIRATES – Diving Safari Red Sea may cancel the travel contract before departure in the following cases:
6.1 Up to 2 weeks before departure
If the minimum number of participants, as stated in the travel description or set by authorities, is not met. SEA PIRATES – Diving Safari Red Sea must notify the customer promptly upon realizing that the trip cannot take place and issue the cancellation notice immediately. Any paid travel price will be refunded promptly.
6.2 Up to 4 weeks before departure
If the execution of the trip is unreasonable due to insufficient bookings and would result in economic hardship for SEA PIRATES – Diving Safari Red Sea, provided this situation is not attributable to the company and no calculation errors occurred. A comparable alternative trip may be offered, or the full travel price will be refunded if no alternative is accepted.
§7 Termination of the Contract Due to Extraordinary Circumstances
If the trip is significantly hindered, endangered, or impaired due to unforeseeable circumstances (e.g., natural disasters, pandemics, uprisings, wars), both SEA PIRATES – Diving Safari Red Sea and the traveler may terminate the contract. Payments already made will be refunded.
§8 Warranty
8.1 Remedy
If the trip is not provided as agreed, the traveler may demand a remedy. SEA PIRATES – Diving Safari Red Sea may refuse the remedy if it requires disproportionate effort.
8.2 Price Reduction
The traveler may request a price reduction for the duration of non-conforming services, provided they immediately report the deficiencies.
8.3 Termination Due to Defects
In case of significant deficiencies, the traveler may terminate the contract if SEA PIRATES – Diving Safari Red Sea fails to provide a remedy within a reasonable period.
8.4 Compensation
The traveler may claim damages for non-performance unless the deficiency is beyond the control of SEA PIRATES – Diving Safari Red Sea.
§9 Duty to Cooperate
The traveler is obliged to cooperate in resolving service issues and mitigating potential damages, including immediately reporting deficiencies to the local travel guide.
§10 Severability Clause
The invalidity of any provision in the travel contract does not affect the validity of the rest of the contract.
§11 Jurisdiction
The traveler may only sue SEA PIRATES – Diving Safari Red Sea at its registered office. Legal actions by SEA PIRATES – Diving Safari Red Sea against the traveler must be brought at the traveler’s place of residence unless otherwise stipulated by specific circumstances.
